Welcome to AirShow23. By participating in, registering for, or claiming any items through our dynamic sales, fixed-price drops, private sales, auctions or falling-price event channels (collectively, the "Services"), you ("Buyer", "you", or "your") explicitly agree to be bound by the following Terms of Sale.
As a licensed platform operating under North Carolina law, these terms form a legally binding contractual agreement between you and AirStar23 LLC. If you do not agree to these terms, you are strictly prohibited from claiming items or checking out on our platform.
1. Electronic Contract Formation & Binding Intent
Pursuant to the North Carolina Uniform Electronic Transactions Act (UETA) [N.C. Gen. Stat. § 66-317], your digital actions carry the full legal weight of a physical, wet-ink signature.
  • The Binding Claim: The exact millisecond you click the "Claim" button on a falling-price ticker, or complete a fixed-price checkout stream, you have legally executed an irreversible "Offer and Acceptance" contract to purchase that specific asset.
  • No Retractions: Because our platform instantly removes claimed physical inventory from public availability to protect our consignors, requests for cancellations due to "buyer’s remorse," accidental clicks, or changing your mind are strictly denied. All claims are final.
2. Dual-Tier Sales Structures & Buyer's Fees
AirShow23 operates distinct sales tiers depending on the value and classification of the memorabilia item. Your financial obligations are strictly determined by the specific tier of the item you claim:
Tier A: Standard "Dogfight or Auction Options" (Items Under $2,500)
  • Buyer's Premium: 0% (No buyer's premium applies).
  • Payment Methods: Automated payment via PayPal or Visa is accepted directly through the checkout screen.
  • Fulfillment: Your payment is subject to manual backend capture by our team before dispatch.
Tier B: "Dogfight Airstrike Premier or Auctions" (High-Value Items Over $2,500)
  • Buyer's Premium: A mandatory 10% Buyer’s Premium will be appended to the final system-recorded falling claim price (the "Hammer Price").
  • Payment Methodology: All transactions over $2,500 are strictly required to be fulfilled via a manual, off-platform Bank Wire Transfer.
  • The Intercept Lock: Any checkout hold attempted on a Premier item via a credit card or PayPal will be treated solely as a security hold. We will not capture funds from that card or account; the hold will be voided and released entirely once your physical bank wire clears our financial institution.
3. High-Ticket Bank Wire Performance Window
For all Tier B ("Airstrike Premier") purchases over $2,500, a finalized manual invoice breaking down the Hammer Price + 10% Buyer's Premium + Insured Shipping will be dispatched to your registered email address immediately following your claim.
  • The 24-Hour Rule: You are contractually obligated to initiate and confirm your domestic bank wire transfer within twenty-four (24) hours of invoice delivery.
  • Proof of Transfer: You must reply to your invoice notice with a physical receipt or digital confirmation screen of the wire transmission from your banking institution within this window.
4. Default, Breach of Contract, and Account Enforcement
Failure to fulfill a bank wire within 24 hours, or attempting to dispute a verified automated checkout hold on a low-ticket item, constitutes a material breach of a legal contract under North Carolina law. In the event of a default:
  • Inventory Forfeiture: AirShow23 reserves the right to instantly cancel your order and return the high-ticket memorabilia item to the live dynamic dogfight auction pool for other buyers.
  • Permanent Banning: Your user account, IP address, physical shipping address, and phone number will be permanently blacklisted and blocked from accessing any future AirShow23 drops or events.
  • Legal Remedies: AirShow23 and its consignors reserve the right to aggressively pursue non-paying buyers for full contract performance, administrative overhead costs, restocking fees, and any loss of asset value caused by the default.
5. Authenticity, Condition, and Warranties
  • Authenticity Guarantee: AirShow23 stands behind the integrity of its sports memorabilia. All items are accompanied by the specific third-party authentication certificates (PSA, JSA, Beckett, GOAT Authentics etc.) detailed explicitly on the item's individual product description page.
  • As-Is Sales: Except for the explicit third-party authenticity certifications listed, all items are sold "As-Is, Where-Is" with all visual or structural characteristics described accurately via high-resolution catalog photography.
6. Governing Law and Venue Jurisdiction
These Terms of Sale and any transactional actions executed on this platform shall be governed by, construed, and enforced in accordance with the statutory laws of the State of North Carolina, without regard to conflict of law principles.
Both parties explicitly agree that any legal claims, disputes, or collection actions arising directly out of a breach of these terms shall be litigated exclusively within courts operating in Johnston County, North Carolina.
